Why should I be cautious about agreeing to arbitration clauses?

Arbitration clauses restrict your legal options if there is a problem, and may favor the company over the consumer. Many arbitration clauses (1) prevent you from obtaining “discovery” (the process of getting internal documents and records from the other side, which most civil lawsuits in the United States allow); (2) pick a private arbitrator that big companies repeatedly use, rather than a judge; and (3) require decisions to be made solely on written submissions or telephonically, which can deprive you of an in-person hearing where live witness testimony can be presented. In addition, in the United States, there are very few ways to appeal an arbitration result.
